What do I need to know before I hire an attorney?
Before you hire an attorney, you should know: (1) how long the attorney has been in practice; (2) what percentage of his or her practice is devoted to family law; (3) how much trial experience he or she has; (4) the number of cases he or she has handled; (5) which counties he or she practices in (it needs to be the same county as where the case is filed); (6) how much of a retainer he or she charges; (7) what his or her hourly rates are; and (8) whether you can pay for his or her services via credit card.
Back to the top.Why do I need to hire a lawyer for a divorce?
Many times people feel they can proceed through a divorce without hiring a lawyer, even if it is a contested divorce. Though it may seem like a simple process at first, there are many details that people who are unexperienced can easily overlook. Problems can creep up in any aspect of the divorce, whether it be in the terms of the child custody agreement (if there are children under the age of 18 or if the wife is pregnant), in the division of property or in the terms of the child support.
Back to the top.Where do I file for a divorce?
Divorces must be filed in the county where the child or children live. If there are no children, then a divorce must be filed in the county where the husband and wife live. If the husband and wife are living in separate counties, then the divorce can be filed in either county. If you are away on military leave, then you can file in the county you consider to be your home.
